Terms and conditions of use

These terms govern access to and use of the Flintwood Academy Learning Management System across learner, facilitator, administrator, and related institutional workflows.

1. Purpose of the platform

Flintwood Academy LMS is a digital learning management platform used to support academic delivery, learner engagement, course administration, assessments, communication, certification, and related educational operations. The platform is intended to provide authorised users with secure access to learning resources, academic records, and institutional services connected to Flintwood Academy.

2. Acceptance of these terms

By registering for, accessing, or using the Flintwood Academy LMS, you agree to be bound by these Terms and Conditions of Use, together with any related institutional policies, academic rules, privacy notices, and operational procedures that apply to your use of the platform. If you do not agree to these terms, you should not use the LMS.

3. Eligibility and account registration

Access to the LMS is limited to users who are authorised by Flintwood Academy or by an affiliated academic or administrative process. You agree to provide accurate, current, and complete registration information and to keep that information updated where necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User roles and access rights

The LMS may provide different levels of access depending on your assigned role, including learner, facilitator, administrator, or other approved user types. Access rights are granted only for legitimate academic, administrative, or support purposes. Flintwood Academy reserves the right to assign, restrict, change, or revoke role-based permissions where necessary for operational, academic, disciplinary, or security reasons.

5. Courses, enrolment, and academic participation

Course access within the LMS is subject to enrolment, programme participation, timetable allocation, facilitator assignment, or other institutional controls. Flintwood Academy may add, remove, reschedule, suspend, or revise courses, modules, lessons, assessments, or learning materials where reasonably required. Users are responsible for engaging with the platform in a timely manner and for monitoring official course updates, deadlines, and announcements.

6. Assessments, submissions, and grading

The LMS may be used for assignments, quizzes, assessments, learner submissions, grading workflows, academic feedback, and facilitator review. Users are responsible for ensuring that submitted work is accurate, complete, properly uploaded, and submitted before applicable deadlines. Flintwood Academy does not guarantee acceptance of late, incomplete, corrupted, or improperly submitted work except where allowed by institutional policy or facilitator discretion. Grades, feedback, and academic outcomes displayed in the LMS remain subject to moderation, verification, appeals processes, and institutional academic governance where applicable.

7. Certificates, transcripts, and academic records

The LMS may display or support the generation of certificates, transcripts, academic progress indicators, completion records, and related learner outcomes. The availability of these records depends on academic completion rules, administrative verification, financial standing where applicable, and institutional approval processes. Display of a status or document in the LMS does not override official academic policy or confer rights beyond those formally granted by Flintwood Academy.

8. Financial records and restrictions

Where relevant, the LMS may display account statements, financial notices, enrolment restrictions, or other administrative holds connected to a user's academic or financial standing. Flintwood Academy may limit access to specific services, records, or workflows where required by institutional policy, outstanding obligations, compliance requirements, or administrative review. Users remain responsible for resolving such matters through the appropriate official channels.

9. Acceptable use

You agree to use the LMS only for lawful, authorised, and education-related purposes. You must not misuse the platform by attempting unauthorised access, interfering with system performance, distributing harmful code, impersonating another user, harvesting data, uploading unlawful or offensive material, infringing intellectual property rights, or engaging in conduct that disrupts teaching, learning, administration, or platform operations. Flintwood Academy may investigate suspected misuse and take appropriate action, including suspension or termination of access.

10. Academic integrity and conduct

All users are expected to uphold standards of academic honesty, respectful communication, and professional conduct when using the LMS. Plagiarism, collusion, cheating, falsification of records, harassment, abusive behaviour, and misuse of academic content or communication tools may result in disciplinary or administrative action in accordance with applicable institutional rules and procedures.

11. Content ownership and intellectual property

Unless otherwise stated, the LMS interface, platform design, branding, institutional content, course structures, and official educational materials are owned by or licensed to Flintwood Academy or the relevant rights holders. Learners and facilitators may retain ownership of original content they create, submit, or upload, subject to the licence necessary for Flintwood Academy to host, process, review, store, and administer that content within the educational context of the LMS. Users may not reproduce, distribute, sell, republish, or exploit LMS content except as permitted by law or authorised in writing.

12. Privacy and data protection

Use of the LMS involves the collection and processing of personal information necessary for account management, educational delivery, academic administration, communication, reporting, support, security, and compliance. Flintwood Academy will handle personal information in accordance with its applicable privacy practices, operational requirements, and legal obligations. Users should review the Privacy Policy for more detailed information about how personal data is handled.

13. Communications and notices

By using the LMS, you agree that Flintwood Academy may send you platform notices, course updates, administrative alerts, notifications, reminders, and related communications through the LMS, email, or other approved channels. You are responsible for checking your account and associated communication channels regularly. Failure to review notices does not invalidate information properly communicated through official channels.

14. Third-party services and integrations

The LMS may rely on or integrate with third-party services for hosting, storage, authentication, file delivery, communications, analytics, embedded media, or other operational functions. Flintwood Academy is not responsible for the independent terms, availability, or policies of those third-party providers, but will take reasonable steps to select and use services appropriate for the platform's educational purpose.

15. Availability, maintenance, and changes to the service

Flintwood Academy aims to keep the LMS available and reliable, but does not guarantee uninterrupted or error-free access at all times. The platform may be unavailable due to maintenance, upgrades, technical failures, security incidents, capacity issues, third-party disruptions, or other operational reasons. Flintwood Academy may modify, suspend, replace, or discontinue any part of the LMS, including features, workflows, or content structures, where reasonably necessary.

16. Suspension and termination

Flintwood Academy may suspend, restrict, or terminate access to the LMS where there is suspected misuse, security risk, breach of these terms, academic or disciplinary action, expired authorisation, administrative closure, or other legitimate institutional reason. Upon suspension or termination, some data or records may remain retained where required for academic, legal, audit, regulatory, or operational purposes.

17. Disclaimers

The LMS is provided on an "as available" and "as is" basis, subject to applicable law. While Flintwood Academy takes reasonable steps to provide accurate and functional services, it does not warrant that the LMS will always be uninterrupted, secure, error-free, fully current, or suitable for every device, browser, or personal circumstance. Users are responsible for maintaining compatible devices, connectivity, and appropriate backup of their own materials where necessary.

18. Limitation of liability

To the maximum extent permitted by applicable law, Flintwood Academy will not be liable for indirect, incidental, consequential, special, or punitive losses arising from or related to use of, inability to use, or reliance on the LMS. Nothing in these terms excludes liability that cannot lawfully be excluded, including any rights that apply under mandatory law.

19. Changes to these terms

Flintwood Academy may update these Terms and Conditions of Use from time to time to reflect operational, legal, academic, technical, or organisational changes. The latest version published on the LMS will apply from its effective date. Continued use of the LMS after updated terms are published constitutes acceptance of those changes, unless applicable law or institutional policy requires a different process.

20. Governing rules and interpretation

These terms should be read together with Flintwood Academy policies, academic rules, learner codes of conduct, facilitator obligations, privacy notices, and any programme-specific requirements that apply to your participation. Where local law imposes mandatory rights or obligations, those provisions will apply to the extent required.
